PAYE Changes

HMRC has issued a reminder to all employers that, from this year, they must file their Employer Annual Returns online by the 19th May 2010 deadline. There is no longer a paper filing option for Small Employers with fewer than 50 staff. So, if you file your return on paper, even if it is before 19th May 2010, you could receive a penalty.

To file online, employers must register with HMRC's PAYE Online Service; www.hmrc.gov.uk/paye and click "Register for PAYE Online"

Statutory Payments

The maximum amount for "a weeks pay" used to calculate redundancy or unfair dismissal remains £380 per week at least until February 2011. The weekly rates for statutory adoption, maternity or paternity allowance will rise from £123.06 to £124.88 in April 2010, while the rate for statutory sick pay remains unchanged at £79.15.

Driver Training / CPC Training

The Driver CPC, EU Directive 2003/59 means that all professional PCV drivers who hold a full, valid category D, D1, D+E or D1+E licence at 10th September 2008 will need to complete 35 hours of periodic training by 10th September 2013. All professional LGV drivers who hold a full, valid category C, C1, C+E or C1+E licence at 10th September 2009 will need to complete 35 hours of periodic training by 10th September 2014.

Carbon Trust Loans

Small businesses can now benefit from loans from the Carbon Trust to reduce their carbon emissions and save money on energy bills by introducing energy efficient equipment.

The minimum loan has been lowered to £3,000, putting loans within reach of smalller businesses, while the upper limit has been doubled from £200,000 to £400,000 to meet the needs of firms with high energy spend, such as manufacturing companies. Road Improvements - Derby Raynesway

New Fit Note from Doctors

A new fit not will replace Doctors Notes from Spring 2010. It will outline what an Employee can do and is intended to help people stay in employment, rather than drift into long term sickness.

Employers will be expected to consider what work an employee can do in order to return to work sooner. For Example, suggesting a job that can be done sitting down rather than standing up if an employee has a mobility problem.

New National Minimum Wage - Oct 2009

From October 2009 the minimum wage rates will increase from;

£5.73 to £5.80 an hour for workers aged 22 and over
£4.77 to £4.83 an hour for workers aged 18-21
£3.53 to £3.57 an hour for workers aged 16-17

The Government has also indicated that the adult minimum wage rate will be extended to 21 year olds from October 2010.

Restrictions on Company Names

New laws coming into effect on 1st October 2009 place greater restrictions on the names limited companies can register with Companies House.

The Company and Business Names Regulations set out which signs, punctuation, symbols and characters can be used in company names and tighten up new rules about registering names that are similar to other companies.

118 800 is a new directory enquiry service that enables you to ask to be connected to a mobile phone of a given individual. Individuals or Parents of children can opt out of the service by visiting the website and registering as ex-directory or calling 0800 138 6263. This procdeure may take up to 4 weeks.

Change for Agency Workers

Under new government proposals, Agency workers are to get the same pay and conditions as permanent staff once they have spent 12 weeks in a given post.

The move comes as part of the Government's implementation of the European Agency Workers Directive and is open to comment until 31st July 2009. The consultation can be accessed at www.berr.gov.uk by clicking on Open Consultations on the left handside of the page.

National Minimum Wage from October 2009

The New National Wage rates will take effect from October 2009.

  • The rate for low paid workers aged 22 and over will increase from £5.73 to £5.80 per hour
  • The rate for 18-21 year olds will increase from £4.77 to £4.83 per hour
  • The rate for 16 and 17 year olds will increase from £3.53 to £3.57 per hour
